ATTENTION RESIDENTS

Community wide yard sale is scheduled for Saturday June 1 and Sunday June 2 from 9 AM to 5 PM. Residents who wish to sell items from their Lot MUST register with the office no later than Friday June 24.  Rain date will be June 8 & 9. Proposed Legislation

For several years a Bill that would assist residents of Manufactured Home communities in our efforts to preserve affordable housing has been proposed. Currently the Bill (S05198 in the NY Senate and A05704 in te NY Assembly) is progressing towards a vote. Your help is needed to get this most important legislation passed.  Write your State Senator or Assembly person asking for their support of this Bill.

 

The Waterfalls Village Homeowners Association was formed on December 20, 2019

by written consent of more than 51% of the Homeowner tenants

The purpose of the Waterfalls Village Community Association is to:

Improve quality of life for park residents.

Keep the park affordable for current and future residents.

Improve maintenance and services for park residents.

Build a sense of community spirit and cooperation.

Educate residents as to their rights and responsibilities under federal, state, and local law.

Establish effective communication between the Association, Waterfalls Village management, the park owner, and the town of Hamburg New York.

Association membership is open to all home owners in Waterfalls Village

except employees of the park owners.

While the Association represents all home owners in Waterfalls Village, membership is not mandatory. We do however ask that you support the

Association by becoming a dues

paying member. Association dues is five dollars annually. To join please

Benefits of a manufactured home park Homeowners Association

 

When it comes to caring for your manufactured home park, welcoming the idea of a Homeowners Association is a brilliant idea. People are more apt to care about their neighbors and the park they live in if they have a voice.

Involvement

Through the manufactured home Homeowners Association, members may pull together to institute a neighborhood watch. They can organize a park-wide cleanup day and host community events. They’ll also take charge of welcoming new residents to your park. Keeping in touch with their neighbors is also an important role.

As you can imagine, allowing a manufactured home Homeowners Association in your park brings out the best in homeowners. They’ll take pride in their community by getting involved.

The Homeowners Association will help their members become better acquainted with their rights and roles in a manufactured home community. Together, they’ll work with park management to improve the manufactured home idea. If the manufactured home community does their part, the manufactured home stigma will soon be a thing of the past.

Mediation

And in case there is a misunderstanding or quarrel between a Homeowners member and park management, the Homeowners Association will step up to the plate. They’ll provide a helping hand in mediation, allowing for better communication and understanding between both parties.

As an organization, the Association will be able to work with local and state legislators to protect manufactured home owners. Should legal action need to be taken, the manufactured home Homeowners Association will be able to stand together in court.

Unfortunately, along with the benefits of embracing a manufactured home park community, there are risks involved. But this is where the manufactured home Homeowners Association steps in. Should the manufactured home park where you live be shut down, they’ll work on your behalf to encourage the local government to help with relocation funds. They’ll also serve as a mediator between you and the property owner to help you in your transition.

 

Manufactured Home Park Tenants Rights

  • The right to be free from retaliation if you make a complaint or join a tenant association;

  • The right to a rent discount if you participate in the STAR (or any other) real property tax exemption program;

  • The right not to be evicted except upon court proceedings;

  • The right to a copy of park rules and regulations and a written statement of all fees at the commencement of occupancy;

  • The right to have rules and regulations applied uniformly to all tenants;

  • The right to be free from unreasonable arbitrary or capricious rules and regulations;

  • The right to a thirty-day written notice prior to any change of rules or regulations;

  • The right to a ten-day period in order to correct a violation of park rules or regulations;

  • The right to a ninety-day written notice prior to increases of fees, charges or assessments;

  • The right not to have rent increased more than once a year, effective January, 2009;

  • The right to have your security deposit held in trust, in an interest-bearing account and to know the name and address of the bank, for parks consisting of six or more sites;

  • The right prior to occupancy to sign a lease for at least a one year term;

  • The right to annual lease renewal(s) to all tenants in good standing;

  • The right to post a For Sale sign on any manufactured home;

  • The right to reasonable notice of any planned disruption of services;

  • The right to purchase a manufactured home from whomever you wish, as either a current or prospective tenant;

  • The right to have essential services furnished at all times, including water, electricity and heat;

  • The right to choose whomever you want as a service-person;

  • The right to refuse to purchase equipment from the park owner;

  • The right to be free from occupancy restrictions in park rules or leases;

  • The right to sell your manufactured home without the requirement that it be removed from the park;

  • The right not to pay a sales commission or fee to the park owner unless the park owner acted pursuant to a written agreement; and

  • The right to a livable, sanitary and safe park under Warranty of Habitability.

and encourages homeowners to care about the park’s well-being.
